Assumption of Risk

By purchasing, possessing, or using any product sold by PeachiPop Studio, the customer acknowledges and accepts all risks associated with the use, misuse, storage, handling, modification, or possession of the product.

Customers are solely responsible for determining whether a product is suitable for its intended use and for supervising any use by children.

Product Safety Disclaimer

PeachiPop Studio products may contain small parts and are not intended for children under three (5) years of age unless specifically stated otherwise.

Customers assume full responsibility for ensuring products are used safely and appropriately.

No Warranties

All products are sold "AS IS" and "AS AVAILABLE" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, durability, or non-infringement, except where prohibited by applicable law.

Limitation of Liability

To the maximum extent permitted by applicable law, PeachiPop Studio, its owners, employees, affiliates, agents, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

The purchase or use of any product;
Improper use, misuse, alteration, or modification of any product;
Injuries to persons, animals, or property;
Choking hazards, allergic reactions, or other physical injuries;
Loss of income, profits, business opportunities, or data;
Shipping delays, lost packages, or carrier-related issues;
Website errors, interruptions, or inaccuracies.

In all circumstances, PeachiPop Studio's total liability shall not exceed the amount paid by the customer for the specific product giving rise to the claim.

Indemnification

By purchasing from PeachiPop Studio, customers agree to indemnify, defend, and hold harmless PeachiPop Studio, its owners, employees, affiliates, agents, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or legal fees arising from the customer's purchase, possession, use, misuse, modification, resale, or distribution of any product.

Custom and Decorative Products

Unless specifically advertised otherwise, products sold by PeachiPop Studio are intended for novelty, decorative, collectible, sensory, or recreational purposes only and are not certified safety devices, medical devices, therapeutic devices, or educational products.
